Defense Team Secures Total Victory in Complex Employment Arbitration

In August 2022, a former employee of a prominent Kern County medical practice filed suit, asserting whistleblower retaliation, age discrimination, breach of contract, and wrongful termination claims. The defense was led by T. Scott Belden as lead trial counsel; Felicia L. Mears, who directed pre-hearing strategy and served as second chair; and Tyler D. Anthony, who developed the evidentiary record, managed substantial discovery, and advanced motion practice.


The matter proceeded to binding arbitration and was litigated intensively for more than two years. The proceedings were marked by expansive discovery requests, numerous depositions, and vigorously contested procedural issues. Throughout, the defense maintained strategic control and executed a focused litigation plan. Targeted motion practice resulted in summary adjudication of two claims before the evidentiary hearing, significantly narrowing the case and strengthening the employer’s position heading into trial.


Over the course of a six-day arbitration hearing, the defense team presented a disciplined, meticulously prepared, and evidence-driven case that systematically addressed and dismantled each factual allegation and legal theory advanced by the claimant. The presentation was structured, comprehensive, and firmly grounded in the record. The arbitrator found in favor of the employer, rejected each of the claimant’s theories of liability, and awarded the claimant no recovery.


This outcome represents a complete defense victory following prolonged, high-stakes litigation.
